1. Agreement and Acceptance

By registering for an account or using Pricebeeper, you agree to be bound by these Terms of Service. If you are using the platform on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these terms.

Pricebeeper is a business-to-business platform designed for competitive price monitoring. By using the service, you confirm that you are acting in a professional or commercial capacity.

2. Service Description

Pricebeeper is a software-as-a-service platform for competitive price monitoring. The platform provides the following features:

• Product catalog management and bulk import
• Automated price tracking across Google Shopping, Amazon, eBay, bol.com, and Kaufland, and the product pages you add
• Price alerts and real-time notifications
• Pricing analytics, forecasts, and market positioning
• Seller scorecards and competitive intelligence
• Multi-region tracking across 67 countries

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and API keys
• Promptly report any unauthorized access to your account
• Maintain only one account per person or legal entity

4. Acceptable Use

You may not use Pricebeeper to:

• Upload illegal, harmful, or infringing content
• Reverse engineer, decompile, or disassemble any part of the platform
• Conduct unauthorized scraping of third-party websites beyond the price monitoring services Pricebeeper provides
• Interfere with or disrupt the platform's infrastructure or operations
• Share account credentials with unauthorized parties
• Use automated tools, bots, or scripts to access the platform outside of Pricebeeper's provided APIs

5. Data Ownership

You retain complete ownership of your product catalog data, including product URLs, titles, and any information you upload to the platform. Pricebeeper processes your data solely to deliver the service functionality you have subscribed to.

Price data collected from publicly available sources (marketplaces, retailer websites) belongs to Pricebeeper. You are granted a license to use this data within the platform and in exported reports for your internal business purposes.

6. Subscription and Billing

Pricebeeper uses a slot-based pricing model. Each tracking slot represents one product monitored in one region. Subscriptions are billed monthly or annually through Stripe.

• Price changes will be communicated with at least 30 days' notice before taking effect
• Cancellations take effect at the end of the current billing period; you retain access until then
• Refunds are considered on a case-by-case basis for annual plans within 14 days of purchase, provided fewer than 50% of tracking slots have been used
• A free tier is available with no credit card required

7. Intellectual Property

Pricebeeper retains all intellectual property rights in the platform, including its algorithms, analytics methodologies, interface design, and underlying technology. You retain ownership of your uploaded catalog data and any reports you export from the platform.

8. Service Availability

We use reasonable efforts to maintain the availability of Pricebeeper but do not guarantee a specific uptime percentage for standard plans. Scheduled maintenance will be communicated in advance. Custom and Enterprise plans may include specific service level agreement (SLA) terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the provider's total liability arising out of or in connection with these terms is limited to the total fees you paid in the twelve (12) months preceding the event giving rise to the claim.

Consequential, incidental, and indirect damages are excluded except in cases of gross negligence, fraud, or violations of mandatory law. Pricebeeper is not liable for any pricing decisions you make based on data provided by the platform.

10. Termination

Either party may terminate the agreement with 30 days' written notice. Upon termination, your data will be retained for 30 days before permanent deletion, giving you time to export any information you need.

Pricebeeper reserves the right to suspend or terminate accounts that violate the acceptable use terms outlined in Section 4, with or without prior notice depending on the severity of the violation.

11. Governing Law

These terms are governed by the laws of the Czech Republic. EU consumers retain the right to bring proceedings in their local courts in accordance with applicable consumer protection regulations. Disputes shall be resolved through good-faith negotiation first, then through the competent courts in Prague.

12. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email with at least 30 days' notice before they take effect. Continued use of the platform after the notice period constitutes acceptance of the updated terms.
